Licence points for smoke-driving?

Interesting to see that confusion reigns over the ban on smoking in company vehicles - see ACFO's chat to the Department of Health on the matter.

Even in clear-cut cases it seems people are ignoring the new rules.

'Primarily' used for company business may not be clear enough for all, but some vehicles, and I'm referring to liveried cars and van here, are clearly almost totally business use so would be subject to a smoking ban. Yet I've seen plenty of drivers and passengers of these vehicles smoking.

My question is, will this be like the phone-driving ban? Will it take the threat of point on your driving licence to stamp it out?
