Kill Bill prosecutions unlikely before 2012

Fleet prosecutions under corporate manslaughter legislation are unlikely before 2012, although some cases may already be in the legal system, according to a solicitor expert in the field.

Speaking exclusively to BusinessCar, Michael Appleby, partner at Housemans Solicitors, said it takes about four years for prosecutions to filter through the system, and the Corporate Manslaughter Act only came into force in April 2008.

"It will start with an easy target, a visible brand, and it will be a maintenance issue, for example tyres, or maybe fatigue," he said.

"We won't see any [prosecutions] until 2012 because it takes four years to work through a case, but there are some that are in the system already," he hinted.

Appleby added that one other factor that has slowed possible prosecutions is that police guidance for investigating corporate manslaughter is only now being published.

Appleby also said the HSE would rely on the police to do the groundwork for a case because it did not have the funding or manpower to carry out its own investigations.
