The regulations, due to come into force on October 1, ban ageism in the workplace and are most likely to affect the way fitness levels are measured, relating to drivers.
Jaama boss Jason Francis said: "To safeguard themselves against potential changes, companies should make sure their duty of care procedures include confirmation of fitness levels.
"Companies should ensure that contracts of employment put the onus on staff to advise of any changes in their fitness levels and whether they are taking any medication which could impact on their ability to drive."
