BVRLA Fleet Technology Congress: Lawyer details new European data compliance headache

Business car managers will be one of the key groups hit by the incoming European data protection legislation that is expected to become law inside the next two years, according to Kirsten Whitfield, a data lawyer at Wragge, Lawrence, Graham & Co.

She said that as cars effectively become computers on wheels, fleets, manufacturers and lease firms would be some of the key users of the data gathered and would have to prepare for the new European-wide legislation.

The new regulations will be finalised by the end of this year, according to Whitfield, and then implemented within two years. However, she warned that because the process has taken so long - it was started in 2012 - the implementation phase may be shortened to one year.

She highlighted that even anonymous, partial personal data - data that could be put together with other sources to work out who it refers to - would be covered by the regulations, and that businesses should be aware of this.

Speaking at the BVRLA conference, Whitfield listed the key new points of the legislation, which include: "No profiling or analytics without consent except in exceptional circumstances, mandatory breach notification, mandatory privacy by design, and the right to be forgotten."
